These Terms of Service ("Terms") govern your access to and use of the website and service available at https://check.nivk.com (the "Site") and the associated Shopify detection functionality (collectively, the "Service"). The Service is operated by Nivk ("we," "us," or the "Operator"). Before publication, insert your full legal entity name and registered address here and ensure these Terms are reviewed by qualified counsel.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms from time to time; the "Last updated" date above reflects the latest version. Continued use after changes constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
1. The Service
Shopify Check is an informational tool that allows you to submit a domain name (or URL that we normalize to a domain). Our systems forward that input to an automated workflow that inspects publicly available technical signals from the corresponding website (for example, HTTP responses, HTML, scripts, and similar data exposed to a normal visitor or client). The Service returns a structured result such as whether the site appears to run on Shopify, confidence or scoring information, detected signals, theme-related hints, and related metadata.
The Service is provided for convenience and general information only. It does not provide access to non-public systems, merchant admin panels, customer records, order data, or any data that is not ordinarily exposed by the target site to the public internet under standard browsing conditions.
We may modify, suspend, or discontinue the Service (in whole or in part) at any time, with or without notice. We do not guarantee uninterrupted availability, error-free operation, or that any particular domain will be analyzed successfully.
2. Eligibility and accounts
The Service is intended for users who can form legally binding contracts under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
The current version of the Service does not require you to create an account. If we introduce accounts or paid features in the future, additional terms may apply and will be presented at that time.
3. Acceptable use
You agree that you will not, and will not attempt to:
- Use the Service for any unlawful purpose or in violation of any applicable law, regulation, or third-party rights.
- Use the Service to harass, threaten, or harm others, or to facilitate discrimination, fraud, or abuse.
- Probe, scan, or test the vulnerability of the Service, our infrastructure, or any third-party system without authorization; circumvent rate limits or security measures; or interfere with the proper working of the Service.
- Submit domains or orchestrate traffic in a manner that imposes an unreasonable load on the Service, our subprocessors, or third-party sites (including denial-of-service style behavior or bulk automated use inconsistent with fair use of a free tool).
- Reverse engineer, decompile, or disassemble any part of the Service except where such restriction is prohibited by law.
- Misrepresent the origin of requests, impersonate others, or use the Service to violate the terms of service or robots policies of third-party websites.
- Use output from the Service as the sole basis for high-risk decisions (for example, legal, security, compliance, or investment decisions) without independent verification.
We may investigate violations and cooperate with law enforcement or regulators. We may suspend or terminate access to the Service for conduct we believe violates these Terms or harms other users, us, or third parties.
4. Your submissions
When you submit a domain or URL, you represent that you have the right to request analysis of that destination for your intended purpose and that your use complies with applicable law and the rights of others. You are solely responsible for the domains and URLs you submit and for how you use the results.
You grant us a limited license to process your submissions solely to operate, secure, and improve the Service, in accordance with our Privacy Policy.
5. Third-party sites and services
The Service may analyze publicly available content from third-party websites that you identify. We do not control those sites. Their terms, privacy practices, and availability are solely their responsibility. A reference to a domain in the Service does not imply affiliation, endorsement, or sponsorship by the Operator or by Shopify Inc. or any other platform.
The Service relies on infrastructure and automation providers (for example, hosting and workflow execution). Their terms may apply to their own services. See our Privacy Policy for a high-level description of how data may be processed by subprocessors.
6. Intellectual property
The Site, its design, branding, text, graphics, and software (except open-source components under their respective licenses) are owned by the Operator or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose.
"Shopify" and related marks are trademarks of Shopify Inc. This Service is not affiliated with or endorsed by Shopify Inc. All other trademarks belong to their respective owners.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Detection results are based on heuristics and public signals and may be incomplete, outdated, or incorrect. A "Shopify" or "Not Shopify" verdict, confidence score, theme name, or app list is not a guarantee of fact. Merchants may use custom stacks, obfuscation, CDNs, or configurations that affect detection. The Service does not constitute legal, security, compliance, or professional advice.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY), OR (B) FIFTY U.S. DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability will be limited to the maximum extent permitted by law.
9. Indemnity
To the fullest extent permitted by law, you will indemnify, defend, and hold harmless the Operator and its affiliates and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your submissions, your violation of these Terms, or your violation of any third-party rights.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we process personal data in connection with the Site and the check workflow.
11. Governing law and disputes
[Insert governing law and venue — for example: "These Terms are governed by the laws of [country/state], without regard to conflict-of-law principles. Exclusive venue for disputes will be the courts located in [city/country]."] Consumer rights that cannot be waived under mandatory local law remain unaffected.
12. General
These Terms constitute the entire agreement between you and the Operator regarding the Service and supersede prior understandings on the same subject. If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
13. Contact
For questions about these Terms, contact: legal@nivk.com. Replace this address with your official legal contact if different.
